For years, real estate developers across Gurugram, Noida, and the Delhi NCR region have argued that once a homebuyer accepts physical possession of an apartment and executes a conveyance deed (sale deed), all past defaults, delays, and compensation claims stand automatically waived.
Shattering this developer-friendly myth, the Punjab and Haryana High Court delivered a monumental verdict holding that acceptance of possession does not extinguish a homebuyer's statutory right to claim delay compensation. The Court firmly established that builders cannot exploit desperate homebuyers who take possession under duress after years of waiting just to secure a roof over their heads.
The judicial pronouncement originated from a batch of petitions concerning an upscale residential project by Emaar MGF located in Sector 102, Gurugram.
As per the buyer agreement signed in November 2013, the possession was originally promised by November 2016. However, the developer delayed the project significantly; the occupation certificate (OC) was only received in May 2019, and conveyance deeds were executed between February and September 2019. When aggrieved homebuyers approached authorities seeking delay interest for the prolonged default period, the developer raised preliminary objections claiming that once possession was handed over and sale deeds signed, no further claims could be entertained. The High Court summarily dismissed the builderтАЩs plea.
